RE: The tariff classification of a glass lamp part from China.

Dear Ms. Bounds:

In your letter dated January 18, 2001, on behalf of the Gerson Company, you requested a tariff classification ruling. The sample is being returned as requested.

The sample submitted is a glass chimney (style number 88271), designed for a hurricane-type of lamp, that measures approximately 8 ¾ inches in height and has an open top and bottom diameter of 3 ½ inches. It is stated that similarly constructed glass chimneys that measure approximately 10 inches, 12 inches and 14 inches high in regard to style numbers 88272, 88273 and 88274, respectively, will also be imported.

The applicable subheading for these glass chimneys will be 9405.91.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for lamps and lighting fittings…and parts thereof not elsewhere specified or included: parts: of glass: chimneys. The rate of duty will be 7.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
